Acceptance of Terms

By installing Viking Watermark on your Shopify store, clicking "Install", or otherwise using the App, you confirm that you have read, understood, and accepted these Terms. If you are accepting on behalf of a business, you confirm that you have authority to bind that business.

Description of the Service

Viking Watermark is a Shopify embedded application that helps merchants:

• Design custom image watermarks (text or image-based).
• Apply watermarks to existing product media in bulk or to single products.
• Automatically watermark new product images on upload (auto-watermark).
• Roll back to original images at any time (originals are preserved in the merchant's own Shopify Files library).
• Enable storefront protection (right-click, drag-and-drop, and DevTools shortcut blocks via a theme app extension).

The App is delivered as a Software-as-a-Service (SaaS) product through the Shopify App Store and Shopify Admin.

Eligibility & Installation

To use Viking Watermark, you must:

• Operate an active Shopify store and have authority to install third-party apps on it.
• Be at least 18 years old (or the age of majority in your jurisdiction).
• Comply with all applicable laws, including Shopify's Acceptable Use Policy and Partner Program Agreement.
• Have a valid Shopify subscription in good standing.

Installation is performed through the Shopify App Store using Shopify's standard OAuth flow. By installing, you grant Viking Watermark the API scopes shown during the install dialog.

Subscription, Billing & Free Plan

Viking Watermark offers a Free plan and paid plans (currently Starter, Growth, and Pro, with both monthly and yearly billing options).

• Free plan: No credit card required. Subject to usage limits documented on the Shopify App Store listing (e.g., maximum number of watermarks, maximum products watermarked per month).
• Paid plans: Billed through Shopify Managed Pricing. Charges appear on your Shopify invoice, not directly from us. Cancellation, plan changes, refund eligibility, and dispute handling follow Shopify's billing policies.
• Plan limits: Each plan has its own feature gates and quotas. If your usage exceeds free-plan limits, premium features will be disabled until you upgrade or until the billing period resets.
• Pricing changes: We may change prices with at least 30 days' notice via in-app notification or email. Continued use after the new price takes effect constitutes acceptance.
• Refunds: Handled per Shopify's standard refund policy. We do not issue direct refunds outside Shopify Billing.

License Grant

Subject to your compliance with these Terms and payment of any applicable fees, we grant you a limited, non-exclusive, non-transferable, revocable license to use Viking Watermark within your Shopify store for the duration of your subscription.

You may not:

• Sublicense, resell, or redistribute the App.
• Reverse-engineer, decompile, or extract the source code (except where applicable law prohibits this restriction).
• Use the App on a Shopify store other than the one(s) where it is installed via the official OAuth flow.

Acceptable Use

You agree not to use Viking Watermark to:

• Watermark images you do not own or have explicit permission to modify.
• Process images that contain illegal, infringing, defamatory, or harmful content.
• Circumvent the App's plan limits (including by creating multiple stores to evade quotas).
• Attempt to overload, attack, probe, or disrupt the App, its servers, or any underlying infrastructure (Shopify, Supabase, Fly.io, Upstash, Resend, Sentry, etc.).
• Interfere with other merchants' use of the App.
• Use the App in violation of any applicable law, regulation, or third-party right.

We may suspend or terminate access if we reasonably believe you have violated this section.

Intellectual Property

• Our IP: Viking Watermark, including the App's name, logo, source code, designs, documentation, and all related intellectual property, is owned by Viking Watermark. Nothing in these Terms transfers any ownership of our IP to you.
• Third-party IP: The App incorporates and depends on third-party software (e.g., Shopify SDKs, Polaris Web Components, Sharp image processing). Their respective licenses apply.
• Feedback: If you submit feedback, suggestions, or feature requests, you grant us a perpetual, royalty-free, worldwide license to use that feedback to improve the App.

Your Content (Product Images & Watermark Designs)

You retain all rights, title, and interest in:

• Your original product images (which remain stored in your own Shopify Files library — we never claim any rights to them).
• Your custom watermark designs (text, fonts, images, color choices, layout settings).
• Your watermarked output images (which are written back into your Shopify product media).

You grant Viking Watermark a limited license to:

• Read, process, and write product media on your store via the Shopify Admin API, solely to deliver the App's functionality.
• Store your watermark configurations in our database so they persist across sessions.
• Upload original-image backups to your own Shopify Files library to enable rollback.

This license terminates automatically when you uninstall the App.

Service Availability & Modifications

• We aim for high availability but do not guarantee uninterrupted, error-free service. Free-plan users have no SLA. Paid-plan SLA, if any, is documented separately.
• We may modify, suspend, or discontinue any feature at any time. Material changes that affect paid features will be announced at least 30 days in advance via in-app notification or email.
• The App depends on third-party services (Shopify, Supabase, Fly.io, Upstash, Resend, Sentry, etc.). Outages or changes in those services may affect availability outside our control.

Termination

• By you: You may terminate at any time by uninstalling the App from your Shopify Admin. Your data is purged from our database immediately as described in our Privacy Policy.
• By us: We may suspend or terminate your access if you breach these Terms, fail to pay applicable fees, or use the App in a way that creates legal, security, or operational risk. We will give reasonable notice unless immediate termination is required (e.g., security incident, abuse, legal order).
• Effect of termination: All licenses granted under these Terms end immediately. Sections that by their nature should survive (IP, disclaimers, limitations of liability, indemnification, governing law) survive termination.

Disclaimers

VIKING WATERMARK IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE DISCLAIM ALL WARRANTIES INCLUDING, WITHOUT LIMITATION, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY.

We do not warrant that:

• The App will meet your specific business needs.
• The App will be uninterrupted, secure, or error-free.
• Watermarks will deter all forms of image theft (the storefront protection layer is a deterrent, not an absolute guarantee).
• Any data, logs, or analytics generated by the App are accurate or complete.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• We shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, including but not limited to loss of profits, revenue, data, goodwill, or business opportunity, arising out of or related to your use of the App.
• Our total cumulative liability to you for any claims arising from or related to the App shall not exceed the greater of (a) the fees you paid us through Shopify Billing in the 12 months preceding the event giving rise to the claim, or (b) US $100.

Some jurisdictions do not allow the limitation of liability for certain damages. In such cases, our liability is limited to the smallest amount permitted by law.

Indemnification

You agree to defend, indemnify, and hold harmless Viking Watermark and our officers, employees, and contractors from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising from:

• Your use of the App in violation of these Terms.
• Your violation of any applicable law or third-party right (including intellectual property rights in images you watermark).
• Content you upload, process, or watermark using the App.

Governing Law & Disputes

These Terms are governed by the laws of the Republic of Turkey, without regard to conflict-of-law principles. Any dispute arising out of or related to these Terms shall be resolved exclusively in the courts of Istanbul, Turkey, and you consent to the jurisdiction of those courts.

If you are a consumer in the European Economic Area, the United Kingdom, or another jurisdiction whose mandatory consumer-protection laws prohibit the above, you may also bring proceedings in your country of residence as required by law.

Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will:

• Update the "Last updated" date at the top of this page.
• Display a notice in the Viking Watermark app dashboard.
• For paid-plan users, send an email to the store owner email on file at least 30 days before the changes take effect.

Continued use of the App after changes take effect constitutes acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the App and uninstall it.
